722 条）、死後懐胎子と亡父の親子関係を設定する制度としては強制認知のみが考えられうる（民法 787 条）。この問題をめぐっては、学説においても賛否両論あり、最高裁の判断が待たれていたところ、最高裁平成 18 年 9 月 4
